The Congress party has filed a civil writ petition in the Chhattisgarh High Court concerning the number of ministers in the state cabinet. The petition alleges that the cabinet’s composition, with 14 ministers after the swearing-in of three new ministers on August 20th, exceeds the constitutionally mandated limit. The High Court is scheduled to hear the case next week. According to the Constitution, the number of ministers in any state cannot exceed 15% of the total number of members in the Legislative Assembly. In Chhattisgarh, the Legislative Assembly has 90 members; 15% of 90 is 13.50, indicating that the cabinet should ideally have no more than 13 ministers. The Congress party asserts that the recent expansion of the cabinet to 14 ministers violates this constitutional provision.
