    Jharkhand High Court News: Ranchi, Rana Pratap-Jharkhand High Court Justice Sanjay Kumar Dwivedi has given an important decision in a case related to the road accident. The court rejected the state government’s appeal, challenging the order to compensate for two youths for death in a road accident. The accident occurred near Khunti district on 11 July 2013, when a police Bolero of a registration number hit a motorcycle. Due to this, two young men Amit Aind (18 years) and Roshan Gudiya (22 years) lost their lives.

    The state government is responsible for negligence

    Justice Sanjay Kumar Dwivedi clarified that when the vehicle belonged to the police department and its driver was on duty, the state government is responsible for his negligence. The court, citing various examples of British and Indian law, said that any owner is responsible for the negligence done in the service of his employee. Even if the order has not been given directly. The court also commented that the role of Welfare State is important in such cases and the government should make a clear policy to give relief to the victims.

    Tribunal’s order justified the correct

    The court dismissed both the appeals and justified the order of the tribunal. At the same time, he also directed to send a copy of the order to the Chief Secretary of the state, so that the justified policy can be considered in matters related to road accidents. The case was brought before the tribunal through two separate motor accident claim petitions. In both the cases, the tribunal, considering the police department responsible, ordered a compensation of Rs 3,48,880 to each victim’s family, including 7.5 percent annual interest. Challenging this order on behalf of the state government, it was said that the Bolero was not run with fast and negligence. There was no fault of the police vehicle in this.
