    Congress MP Rahul Gandhi has appealed to the Allahabad High Court against an order from the special judge (MP-MLA) court in Varanasi. The subordinate court had referred a case related to a plea for an FIR against Rahul Gandhi to the ACJM court. This case concerns a statement made by Rahul Gandhi in 2024 about Sikhs in America.

    The matter is listed before a bench of Justice Samir Jain, with a hearing scheduled for today. A Varanasi resident, Nageshwar Mishra, had filed an application before the Additional Chief Judicial Magistrate (MP-MLA) of Varanasi. The ACJM court had earlier dismissed the application seeking an FIR against Rahul Gandhi on November 28, 2024.

    The court had stated that the speech was delivered in America, thus, the matter was outside its jurisdiction. Challenging the dismissal, Rao appealed to the revision court, which accepted his revision petition and directed the ACJM to rehear the case.

    The case dates back to September 2024. During an event in America, Rahul Gandhi allegedly said that the atmosphere in India was not good for Sikhs. His statement faced criticism and was described as provocative and divisive.

    Nageshwar Mishra, a resident of Varanasi, attempted to file an FIR against the statement at the Sarnath police station in Varanasi. When this failed, he filed an application in court to register an FIR against Rahul Gandhi. The judicial magistrate dismissed his application on November 28, 2024, stating that the matter pertained to a speech made in America and was outside its jurisdiction.

    Subsequently, Nageshwar Mishra filed a revision petition in the sessions court, which was accepted on July 21, 2025. Rahul Gandhi has now filed a revision petition in the Allahabad High Court against this decision, arguing that the Varanasi court’s order is incorrect, illegal, and beyond its jurisdiction.
